PATENT PENDING & INTELLECTUAL PROPERTY PROTECTION NOTICE 🔒

ATTRAKT by FUEL + FYRE CO.™ — including its signature three-layer construction (Front Tag, Magnacore magnetic core, Back Tag), the Lockball + Shackle system, and all aesthetic and functional design elements — is Patent Pending in Canada and the United States.

All rights are exclusively reserved.

 

ANY UNAUTHORIZED ATTEMPT TO:

• Reverse engineer

• Replicate its structural or magnetic mechanisms

• Manufacture derivative or competing designs

• Commercially reproduce or imitate its proprietary configuration

…will be considered a direct infringement, subject to immediate legal action in Canada, the U.S., and other applicable jurisdictions.

FUEL + FYRE CO. actively monitors for infringement and will enforce its rights to the fullest extent permitted by law. This notice is non-negotiable and applies to all elements of ATTRAKT by FUEL + FYRE CO.™.

 

1. ACCEPTANCE OF TERMS

By completing a purchase from FUEL + FYRE CO., you acknowledge that you have read and agree to all Conditions and Policies herein.

• Minimum age: 14 years

• Use restriction: Adult jewelry only; not intended for pets

• FUEL + FYRE CO. reserves the right to refuse service at its sole discretion

2. GOVERNING LAW & MANDATORY ARBITRATION

These Terms are governed by the laws of Manitoba, Canada.

All disputes, claims, or controversies shall be resolved exclusively through mandatory arbitration in Manitoba. Decisions rendered by the arbitrator are final and binding.

Customers waive the right to participate in class actions or collective proceedings.

 

3. SAFETY & MAGNET DISCLAIMER

The Magnacore contains a high-strength neodymium magnet and is brittle.

IMPORTANT WARNINGS:

• Not for children under 14

• Not for pets

• Individuals with pacemakers or implanted medical devices should not use

• Small components (three Lockball + Shackle sets) present choking hazards

• Avoid ingestion of any component

• Handle Magnacore with care to prevent breakage

FUEL + FYRE CO. is not responsible for misuse or improper handling.

 

4. PRODUCT CARE & ALIGNMENT GUIDANCE

• Avoid water exposure and excessive heat

• Clean only with non-corrosive, non-abrasive cleaners

• Store in a dry environment

• If the three-layer alignment shifts or Magnacore misaligns, contact FUEL + FYRE CO. via the website chat function for guidance

5. RETURNS & EXCHANGES POLICY

• All sales are final

• Exchanges only for:

• Engraving errors made by FUEL + FYRE CO.

• Missing components

• Confirmed defects

• Report issues within 14 days of receipt

• FUEL + FYRE CO. covers return shipping for confirmed defects

• Minor aesthetic imperfections do not qualify for exchanges

Customer-submitted personalization errors are the responsibility of the customer; goodwill replacements may be offered at FUEL + FYRE CO.’s discretion.

6. SHIPPING POLICY

• Signature required for all shipments

• U.S. customers are responsible for duties, tariffs, and applicable taxes

• Shipping insurance is included only for Auction Haus Editions via eBay

• FUEL + FYRE CO. is not responsible for customs delays

7. CONTENT & SUBMISSION POLICY

FUEL + FYRE CO. reserves the right to refuse any order containing:

• Violence, hate speech, nudity, political messaging, or weapons

• Profanity, religious messaging, or drug references

• Trademarked or celebrity images

Refused orders will be fully refunded. Customers affirm ownership or permission to use submitted content.

8. LICENSE TO USE SUBMITTED CONTENT

By submitting designs/photos and providing consent:

• You grant FUEL + FYRE CO. a perpetual, worldwide, royalty-free license

• Usage may include: marketing, website display, social media, and promotional materials

• Applies only where explicit consent is provided

9. FAN EDITION AGREEMENT

• Selection for production is at FUEL + FYRE CO.’s discretion

• Selected designs may be produced in a 10-piece Limited Edition

• No compensation is provided

• All rights are transferred or licensed to FUEL + FYRE CO.

• Designs may be modified for production

10. LIMITED EDITION & RESALE DISCLAIMER

• Edition numbers assigned randomly

• Customers cannot select specific numbers

• Resale value dictated by market conditions

• FUEL + FYRE CO. does not influence resale value

• Third-party resale, including eBay, is permitted

11. AUCTION HAUS EDITION POLICY

• One-of-a-kind designs, sold via eBay weekly

• Sales are final

• FUEL + FYRE CO. is not responsible for eBay operations

• Signature and insurance included

12. PRIVACY POLICY

Customer data collected via the order form is:

• Used solely for order processing, fulfillment, and communication

• Stored securely and handled privately

• Not sold under any circumstances

Public use of submitted designs/photos occurs only with explicit consent.

13. RIGHT TO REFUSE SERVICE

FUEL + FYRE CO. reserves the right to refuse service at its sole discretion, including but not limited to: content violations, suspected misuse, or orders that jeopardize the integrity of the brand.

14. RIGHT TO MODIFY POLICIES

FUEL + FYRE CO. reserves the right to update or modify policies at any time. Changes are effective immediately upon posting to the website.
